The short version
Here’s the plain-language gist. It doesn’t replace the full terms below, but it’s the heart of them:
• Off Script Parenting gives you plain-language guides and coaching-style ideas to try at home. It is education and coaching — not therapy, diagnosis, or medical advice, and using it doesn’t make us your therapist or clinician. • It is not a crisis service. If someone may be unsafe, contact 111 (NZ) or your local emergency number. You can also call or text 1737 in New Zealand, or find a helpline at findahelpline.com. • Membership is a subscription. You can read the free guides for nothing; the full library is for paying members. Paid membership renews automatically until you cancel, and you can cancel anytime — your access then runs to the end of the period you’ve paid for. • The guides are for you and your family’s personal use. Please don’t share your login or copy and redistribute the content. • Nothing here takes away the rights you have under New Zealand consumer law. |
1. About these terms
1.1 These terms apply to your use of the Off Script Parenting website at offscriptparenting.com (the “Site”) and to any free or paid membership, content, guides, newsletters and related services we provide (together, the “Services”).
1.2 In these terms, “we”, “us” and “our” mean OffScript Parenting Limited (New Zealand company number 9429257, NZBN 9429053669858), trading as Off Script Parenting; “you” means the person using the Services. We are based in Wellington, Aotearoa New Zealand.
1.3 By creating an account, subscribing, or otherwise using the Services, you agree to these terms. If you don’t agree, please don’t use the Services.
1.4 We may update these terms from time to time (see clause 16). The version published on the Site applies to your use of the Services. Our Privacy Policy (available on our website) also applies and forms part of these terms.
2. What Off Script Parenting is — and what it isn’t
2.1 Off Script Parenting provides general parenting education (“psychoeducation”) and coaching-style information. We translate research into plain-language guides and practical ideas you can choose to try at home.
2.2 We do not provide therapy, counselling, assessment, diagnosis, treatment, or medical, psychological or other healthcare services. The Services are not a substitute for advice, assessment or treatment from a qualified health professional.
2.3 We are not acting as your (or your child’s) psychologist, psychiatrist, counsellor, therapist, doctor or other regulated health practitioner, and using the Services does not create any therapeutic, clinical or other professional relationship between us.
2.4 Our content is general in nature. It is not personalised advice, and it cannot take account of your family’s particular circumstances. You are responsible for deciding whether and how any idea fits your child and your situation, and for the choices you make as a parent or caregiver.
2.5 Always seek advice from a qualified professional about any concern relating to your child’s or your own physical or mental health, development or wellbeing. Never disregard or delay seeking professional advice because of something you have read or heard through the Services.
3. Not an emergency or crisis service
3.1 The Services are not designed for emergencies or crises and are not monitored in real time.
3.2 If you are worried that you, your child, or anyone else may be unsafe or at risk of harm, contact emergency services immediately on 111 (in New Zealand) or your local emergency number.
3.3 For mental-health or emotional support in New Zealand, you can free-call or text 1737 any time to talk with a trained counsellor. If you are outside New Zealand, you can find a local helpline at findahelpline.com.
4. Who can use the Services
4.1 You must be at least 18 years old and able to enter into a binding contract to create an account or buy a membership.
4.2 The Services are intended for parents, caregivers and other adults. They are not directed at children, and content is about parenting rather than for use by children themselves.
4.3 We provide the Services from New Zealand. They are intended to be useful internationally, but we make no promise that the content is appropriate or available for use in any particular country, and you are responsible for complying with any laws that apply to you.
5. Your account
5.1 You may need an account to access some Services. Please give accurate, current information and keep it up to date.
5.2 Your account is personal to you. Keep your login details secure and don’t share them. You are responsible for activity that happens under your account.
5.3 Tell us promptly if you think your account has been used without your permission.
5.4 We may suspend or close accounts as set out in clause 17.
6. Membership and content
6.1 We offer free content that anyone can read, and a paid membership that unlocks the full library of guides and any member-only features we provide from time to time.
6.2 We may add, change, improve or remove content and features, and we expect the library to grow over time. We don’t promise that any particular guide or feature will always be available.
6.3 Our content is intended to be informative and supportive. We don’t promise any particular outcome or result from using it — parenting is individual, and what helps one family may not suit another.
7. Payments, billing and automatic renewal
7.1 The price of paid membership, and the billing options available, are as shown on the website at the time you subscribe.
7.2 We may vary membership prices from time to time. We’ll give you reasonable notice before a change affects you, and any new price will only apply from your next billing period. If you don’t accept a price change, you can cancel before it takes effect.
7.3 Payments are processed by our payment provider, Stripe. By subscribing you authorise us (through Stripe) to charge your chosen payment method for the membership fee on each billing date. We don’t store your full card details.
7.4 Automatic renewal. Paid membership renews automatically at the end of each billing period (for example, each month) and your payment method is charged for the next period, until you cancel. By subscribing, you agree to this ongoing automatic renewal.
7.5 We are registered for GST in New Zealand, and membership prices are inclusive of GST where it applies.
7.6 If a payment fails, we may retry it and may suspend or end your paid access until payment is made. You’re responsible for keeping your payment details current.
8. Cancelling and refunds
8.1 You can cancel your paid membership at any time, with no cancellation fee, from your member account. To cancel: (a) sign in to your account on the website using the account or sign-in link (it’s in the site menu, and at the bottom of the emails we send you); (b) open your account area (the member portal); and (c) under your membership or plan, select “Cancel subscription” and confirm. Your membership then stops renewing and stays active until the end of your current paid period. If you have any trouble, email coach@offscriptparenting.com and we’ll help.
8.2 When you cancel, your membership stays active until the end of the period you’ve already paid for, and then it won’t renew. You keep access to paid content until that date.
8.3 Except where the law requires otherwise, membership fees are non-refundable and we don’t give partial refunds for the unused part of a billing period.
8.4 Your consumer rights. Nothing in these terms limits or excludes rights you have that can’t be excluded under New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. If we fail to meet a guarantee that applies to you as a consumer, you have the remedies the law provides.
9. Acceptable use
9.1 Your membership and the content are for your own personal, non-commercial use as a parent or caregiver. When using the Services, you agree not to:
share, sell or transfer your account or login, or let others access paid content through your account;
copy, reproduce, republish, distribute, resell or publicly share the guides or other content, except for the personal use the Services are designed for (for example, saving a pocket-cue card for your own family);
scrape, harvest, or use automated means to collect content, or attempt to access parts of the Services you’re not authorised to use;
interfere with or disrupt the Services, or use them for anything unlawful, harmful, or in breach of these terms;
misrepresent the content as professional, clinical or therapeutic advice.
9.2 If you breach this clause we may suspend or end your access (see clause 17).
10. Our content and intellectual property
10.1 We (or our licensors) own all intellectual property in the Services, including the guides, written content, illustrations, brand, name, logo and design. “Off Script Parenting” and our logo are our trade marks.
10.2 While your membership is active, we give you a personal, limited, non-exclusive, non-transferable licence to access and use the content for your own personal, non-commercial use. We don’t transfer any ownership to you, and all rights we don’t expressly grant are reserved.
10.3 If you send us feedback or suggestions, you agree we may use them to improve the Services without any obligation to you.
11. Third-party services and links
11.1 We rely on third-party providers to deliver the Services — for example, our publishing platform and our payment provider, Stripe. Your use of those services may also be subject to their own terms.
11.2 The Services may link to or mention third-party websites, organisations or resources (including support helplines). We provide these for information only. We don’t control them, we’re not responsible for them, and mentioning them isn’t an endorsement.
12. Privacy
12.1 We handle personal information in line with our Privacy Policy (available on our website) and the Privacy Act 2020. Please read it to understand what we collect and how we use it.
13. Disclaimers
13.1 The Services and content are provided on an “as is” and “as available” basis, for general information and education.
13.2 To the extent permitted by law, we don’t give any warranties about the Services — including that they will be uninterrupted, error-free, or that the content is complete, current or suitable for your particular situation — and we exclude warranties not expressly stated in these terms.
13.3 Consumer guarantees. If you are a “consumer” under the Consumer Guarantees Act 1993, that Act gives you guarantees we can’t exclude, and nothing in these terms limits those rights. If you acquire the Services for the purposes of a business, you agree the Consumer Guarantees Act does not apply, to the extent the law allows you to agree that.
14. Our liability
14.1 Nothing in these terms limits or excludes any liability that can’t be limited or excluded by law (including under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986).
14.2 Subject to clause 14.1, and to the maximum extent the law allows:
we are not liable for any indirect, consequential, or special loss, or for any loss of profits, savings, data or goodwill, arising from your use of (or inability to use) the Services; and
our total liability to you in connection with the Services is limited to the total membership fees you paid us in the 12 months before the event giving rise to the liability.
14.3 You are responsible for the parenting decisions you make. Because our content is general education and not professional advice, we are not responsible for outcomes that depend on your own judgement and circumstances.
15. Indemnity
15.1 You agree to reimburse us for reasonable losses we suffer arising from your breach of these terms or your unlawful or infringing use of the Services.
16. Changes to the Services and these terms
16.1 We may change, suspend or discontinue all or part of the Services. We’ll try to give reasonable notice of significant changes that affect you.
16.2 We may update these terms from time to time. If we make a material change, we’ll take reasonable steps to let you know (for example, by notice on the Site or by email). Changes take effect when we publish the updated terms, and your continued use of the Services after that means you accept them.
17. Suspension and ending your access
17.1 You can stop using the Services at any time, and you can cancel a paid membership as set out in clause 8.
17.2 We may suspend or end your access (in whole or part) if you breach these terms (including any inappropriate or unsafe behaviour), if we reasonably need to protect the Services or other people, or if payment fails. Where it’s reasonable to do so, we’ll give you notice. If we end your access because of your breach, fees already paid are not refunded (see clause 8.3).
17.3 Clauses that by their nature should survive (including clauses 2, 3, 10, 13, 14, 15 and 18) continue after your access ends.
18. Governing law and disputes
18.1 These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction over any dispute.
18.2 If a dispute arises, we’d like the chance to put it right. Please contact us first with written details of the problem (email is fine), and we’ll work with you in good faith to resolve it promptly. If we can’t resolve it together within a reasonable time, we may both agree to use a low-cost independent process such as mediation before taking the matter to court. Nothing in this clause affects your rights as a consumer, including taking a claim to the Disputes Tribunal or seeking help through Consumer Protection (consumerprotection.govt.nz).
19. General
19.1 These terms (with our Privacy Policy and the information shown at sign-up) are the whole agreement between us about the Services.
19.2 If any part of these terms can’t be enforced, the rest still applies.
19.3 If we don’t enforce a right straight away, we don’t give it up.
19.4 You can’t transfer your rights under these terms without our consent. We may transfer ours (for example, if the business is restructured or sold), and we’ll let you know if that affects you.
19.5 We’re not liable for failures or delays caused by things outside our reasonable control.
19.6 These terms don’t create any partnership or agency between us.
